The contract gives the customer the right to use the software described below as a learning tool for the pupils. The contract regulates the rights and obligations of the parties in using the software. In addition, the contract sets up the general conditions for the support given by the supplier.
The agreement is valid for 1 (one) year from the date of the signing of the contract. Any exceptions are described in "Attachments"

The supplier is responsible for delivering the web based software (database wwth adapted interfaces) BrainBank Learning. The supplier does not have the rights to access the Customer' s accounts without written consent, with the exception of support and technical maintenance.
The supplier will give technical support to the Customer. Inquires for support must be channeled through the system administrator.
The customer may use BrainBank Learning for their own staff and for the school's pupil
The customer may neither use the software for teaching in other scenarios than the on decribed above, nor commercially (i.e computer classes where the pupil / course attendee pays for the course, or where the school receives any kind of remuneration for the training).
The customers must at all times have an appointed responsible system administrator at each school (the person's name and e-mail address must be entered in this contract). If the customer changes system administrator, the supplier must be informed of the person's name and e-mail address.
The customer is responsible for content produced and uploaded to the application by ithe customer's users. The customer also has the responsibility to monitor use of BrainBank Learning, and to delete any offensive or illegal material entered or uploaded to the application.
The customer must provide a satisfying course venue having a satisfactory amount of computers available to the users ( maximum 2 users per computer) for training to take place.
BrainBank Learning has the following technical requirements:
The right of ownership to the software is held by the Supplier. The Customer may not fully or partially transfer the license to a third party without written consent from the Supplier.
The rights and duties of the parties in this agreement are defined in their entirety by Norwegian law. If there is a disagreement between the parties on the interpretation of, the legalities of, or other issues regarding this agreement, the disagreement is sought to be solved by negotiations.
In the case that the negotiations reach no satisfying conclusion for the parties, each party may bring the case in front of the ordinary courts, unless the parties agree by arbitration.
This contract is valid as long as the Supplier and the Customer finds funding for the license, follow-up and transfer of competence by external project funding. Part from this, the Customer has the right one (1) year of use of the software form the expiration date of the project funding. The intention is that the parties within this period, will agree on an agreement which regulates future use.
